The U.S. Supreme Court begins its new term Monday with arguments in a case that could determine whether state-level climate lawsuits against major oil companies can proceed.
ExxonMobil and Suncor Energy are asking the court to block a lawsuit filed by Boulder, Colorado, that seeks damages for climate-related costs.
Nearly 60 similar lawsuits could be affected
Boulder alleges the companies contributed to climate change and misled the public about the risks of fossil fuels. The companies argue that federal law, rather than state law, should govern claims involving global emissions.
The Trump administration supports the companies’ position that federal law preempts the Colorado claims.
Court is deciding where the case can be heard
The immediate dispute is largely about legal authority and whether the lawsuit can proceed under state law, not whether Exxon or Suncor are ultimately liable for climate damages.
A ruling could shape dozens of similar cases filed by U.S. states and municipalities. A decision is expected by the end of the court’s term.
